1. Introduction

These Terms of Service (the "Terms") govern access to and use of the website lakecomoboatfinder.com (the "Platform") and the related services provided therein.

The Platform is operated by:

(hereinafter, the "Operator" or the "Platform").

These Terms constitute a legally binding agreement between the user of the Platform (the "User") and the Operator.

2. Description of the Service

The Platform provides an online intermediation service aimed at facilitating contact between users interested in boat-related services on Lake Como and independent boat operators (the "Skippers").

In particular, the Platform enables Users to search for available Skippers based on selected criteria, such as location, date, budget, and number of participants.

Upon payment of a one-time fee (the "Unlock Fee"), Users may obtain access to the contact details of a selected Skipper, in order to establish direct communication outside the Platform.

It is expressly clarified that the service provided by the Platform consists exclusively in the facilitation of contact between Users and Skippers.

In particular, the Operator:

  • does not provide, organise, or manage boat tours, rentals, or transport services;
  • does not act as a travel agency, tour operator, broker, or transport provider;
  • does not enter into any contractual relationship between Users and Skippers in relation to the services offered by the latter;
  • does not determine or control the prices, availability, or conditions of the services offered by Skippers, which are set independently by each Skipper.

Any agreement concerning boat tours, rentals, or related services is concluded directly between the User and the Skipper, without any involvement of the Operator.

Accordingly, the Operator is not a party to such agreements and does not assume any obligations or liabilities in relation to their performance.

The Platform does not guarantee:

  • the availability of any Skipper;
  • the response time or responsiveness of Skippers;
  • the quality, safety, legality, or suitability of the services offered;
  • the accuracy or completeness of the information provided by Skippers.

Users are informed that Skippers operate as independent professionals and are solely responsible for the services they offer, including compliance with applicable laws and regulations.

Nothing in these Terms shall limit or exclude any rights granted to Users qualifying as consumers under applicable consumer protection laws, including the Italian Consumer Code (Legislative Decree No. 206/2005).

3. User Accounts and Access to the Service

3.1 Tourist Users

Users accessing the Platform as consumers ("Tourists") are not required to create an account in order to browse available Skippers and use the search functionalities.

In order to access a Skipper's contact details, the Tourist is required to complete a payment through the Platform.

The access to such contact details is linked to the user's browser session and is made available for a limited period of time (24 hours), through the use of technical session identifiers.

3.2 Skipper Accounts

Users who intend to offer services through the Platform ("Skippers") are required to create an account by providing accurate and complete information necessary for the operation of the service.

In particular, Skippers are required to provide:

  • identification and contact details (including WhatsApp number);
  • information relating to the boat and services offered;
  • a valid navigation licence (uploaded in digital format);
  • at least one photograph of the boat.

Account activation is subject to a preliminary review by the Platform.

The Operator reserves the right to refuse, suspend, or terminate accounts in the event of violations of these Terms or where necessary to ensure the proper functioning and integrity of the Platform, without prejudice to applicable mandatory provisions of law.

3.3 Accuracy of Information

All Users undertake to provide accurate, up-to-date and complete information.

The provision of false, inaccurate, or misleading information may result in suspension or termination of access to the Platform.

4. Unlock Fee, Payment and Right of Withdrawal

4.1 Nature of the Service

The service provided by the Platform consists exclusively in granting access to the contact details of a selected Skipper.

Such service is supplied in digital form and is delivered immediately upon successful completion of the payment.

4.2 Payment

The Unlock Fee is equal to €1 (one euro) for each Skipper contact and is payable through the payment methods made available via the Platform.

Before completing the payment, the User is provided with clear information regarding:

  • the nature of the service;
  • the price;
  • the immediate execution of the service;
  • the conditions relating to the right of withdrawal.

4.3 Right of Withdrawal (Consumers)

Where the User qualifies as a consumer within the meaning of the Italian Consumer Code (Legislative Decree No. 206/2005), they would normally have the right to withdraw from a distance contract within 14 days, pursuant to Articles 52 et seq. of the Consumer Code.

However, pursuant to Article 59(1)(a) of the Consumer Code, the right of withdrawal does not apply where:

  • the performance of the service has begun;
  • the consumer has given their prior express consent to such performance; and
  • the consumer has acknowledged that they will lose their right of withdrawal once the contract has been fully performed.

4.4 Express Consent and Waiver of Withdrawal Right

By proceeding with the payment, the User:

  • expressly requests the immediate performance of the service;
  • acknowledges that the service is fully performed at the moment the contact details are made available;
  • expressly acknowledges and accepts that, as a consequence, they lose their right of withdrawal pursuant to Article 59(1)(a) of the Italian Consumer Code.

The Platform ensures that such consent and acknowledgement are collected through appropriate mechanisms prior to the completion of the purchase.

4.5 Refund Policy

In light of the above, once the service has been fully performed (i.e. once access to the Skipper's contact details has been granted), the Unlock Fee is not refundable.

This is without prejudice to the User's rights in the event of non-performance or defective performance of the service attributable to the Platform.

It is expressly clarified that:

  • the service consists solely in providing access to contact details;
  • the Platform does not guarantee the availability, responsiveness, or acceptance of requests by the Skipper.

No refund shall be due on the basis that the Skipper is unavailable, does not respond, or declines to provide services.

4.6 No Guarantee of Booking

The Unlock Fee grants access to contact details only and does not constitute, nor imply, any booking, reservation, or guarantee of service.

Any subsequent agreement is concluded directly between the User and the Skipper.

5. Role of the Platform and Allocation of Responsibilities

5.1 Nature of the Service

The Platform provides an online information society service consisting exclusively in facilitating contact between Users and independent service providers ("Skippers").

The Operator acts solely as a technical intermediary within the meaning of Directive 2000/31/EC and Legislative Decree No. 70/2003.

The Platform does not provide boat transport, rental, or tour services and does not act as a travel agency, tour operator, or transport provider.

5.2 Absence of Contractual Involvement

The Platform enables Users to establish contact with Skippers, but does not participate in, nor is it a party to, any agreement subsequently concluded between them.

Any contractual relationship relating to boat tours, rentals, or transport services is entered into directly between the User and the Skipper, under their sole responsibility.

5.3 Independence of Skippers

Skippers operate as independent professionals.

They are not employees, agents, representatives, or partners of the Operator.

Each Skipper is solely responsible for:

  • the organisation and provision of the services offered;
  • compliance with applicable laws and regulations;
  • the accuracy of the information provided on the Platform;
  • the possession of all required licences, authorisations, and insurance coverage.

5.4 Information and Content Provided by Skippers

The Platform makes available information and content provided directly by Skippers.

The Operator does not carry out systematic verification of such information and cannot guarantee its accuracy, completeness, or reliability.

Any documentation uploaded by Skippers (including navigation licences) is collected for the purposes of operating the Platform, without implying any certification, validation, or endorsement by the Operator.

5.5 Scope of the Service and User Responsibilities

Users acknowledge that the service provided by the Platform is limited to facilitating contact.

In particular, Users are responsible for:

  • independently assessing the suitability, reliability, and qualifications of the Skipper;
  • verifying, where appropriate, licences, insurance coverage, and safety conditions;
  • evaluating the terms and conditions of any service before entering into an agreement.

The Operator does not intervene in, supervise, or control the services offered by Skippers.

5.6 Limitation of Liability

The Operator shall be liable only for damages directly attributable to its own wilful misconduct (dolo) or gross negligence (colpa grave), within the limits permitted by applicable law.

The Operator shall not be liable for damages or losses arising from relationships, agreements, or services provided by Skippers, which remain entirely outside the scope of the Platform.

In particular, the Operator shall not be responsible for:

  • the performance, non-performance, or improper performance of services offered by Skippers;
  • the availability, responsiveness, or conduct of Skippers;
  • any inaccuracies or omissions in the information provided by Skippers;
  • any damages arising in connection with boat tours, rentals, or transport services arranged between Users and Skippers.

5.7 Mandatory Consumer Protection

Nothing in this Article shall exclude or limit:

  • any rights granted to Users qualifying as consumers under the Italian Consumer Code (Legislative Decree No. 206/2005);
  • any liability that cannot be excluded or limited under applicable law.

6. Obligations of Skippers

By registering on the Platform and making their services available to Users, Skippers undertake to comply with the obligations set out in this Article. Such obligations are essential for ensuring the proper functioning of the Platform and the reliability of the services offered.

In particular, Skippers are required to operate in full compliance with applicable laws and to provide accurate and up-to-date information at all times.

6.1 Licences and Authorisations

In order to offer services through the Platform, the Skipper must hold all licences and authorisations required under applicable laws and regulations.

In this respect:

  • the Skipper shall ensure that all licences and permits required to carry out the relevant activity are valid and effective;
  • any documentation uploaded to the Platform, including navigation licences, must be accurate and up to date;
  • in the event of expiry, revocation, or invalidity of any required authorisation, the Skipper shall promptly update or remove the relevant listing.

Failure to comply with these obligations may result in suspension or removal from the Platform.

6.2 Insurance Coverage

The provision of services through the Platform requires adequate insurance coverage.

Accordingly:

  • the Skipper shall maintain valid civil liability insurance covering the activities offered and any passengers transported;
  • such insurance must remain effective for the entire duration of the activity carried out through the Platform.

The Skipper remains solely responsible for ensuring the adequacy and continuity of such coverage.

6.3 Safety and Regulatory Compliance

Given the nature of the services offered, particular importance is placed on safety and regulatory compliance.

In particular:

  • the Skipper shall ensure that all boats are seaworthy, properly maintained, and equipped in accordance with applicable safety regulations;
  • the Skipper shall comply with all relevant Italian and European laws relating to navigation and passenger transport;
  • the Skipper shall provide Users with appropriate safety instructions and equipment where required.

6.4 Services Offered

The Platform allows Skippers to offer different types of services; however, such services must always comply with applicable legal requirements.

In particular:

  • the Skipper may only offer services that are lawful and duly authorised;
  • the Skipper shall ensure that they hold any additional qualifications or permits required for the specific services offered;
  • the Skipper shall refrain from offering services for which they are not legally authorised.

6.5 Tax and Administrative Compliance

Skippers remain fully responsible for complying with all tax and administrative obligations connected with their activity.

In particular:

  • the Skipper shall comply with all obligations relating to VAT (P.IVA), invoicing, and tax reporting;
  • the Operator shall have no responsibility in relation to the Skipper's tax position or compliance.

6.6 Accuracy and Updating of Information

The proper functioning of the Platform depends on the accuracy of the information provided.

For this reason:

  • the Skipper shall ensure that all information published on the Platform is accurate, complete, and not misleading;
  • the Skipper shall promptly update any information that becomes inaccurate or outdated.

6.7 Availability and Management of Listings

The Skipper is responsible for the correct management of their listings.

In particular:

  • the Skipper shall ensure that availability, pricing, and service details are accurate and up to date;
  • any discrepancy between the information published and the actual availability of the service shall remain under the sole responsibility of the Skipper.

6.8 Liability of the Skipper

In light of the above, the Skipper remains solely responsible for the services offered through the Platform.

In particular the Skipper is:

  • responsible for the performance of the services provided;
  • responsible for compliance with applicable laws and regulations;
  • liable for any damages caused to Users or third parties in connection with the services;
  • responsible for the accuracy of the information and documentation provided.

The Skipper shall hold the Operator harmless from any claims arising from breaches of these obligations, within the limits permitted by applicable law.

7. Obligations of Users (Tourists)

Users accessing the Platform as Tourists are required to use the service in a responsible and informed manner, taking into account the nature of the Platform as a mere facilitator of contact.

In particular, Users acknowledge that the Platform does not provide the services offered by Skippers and that any decision to engage with a Skipper is taken autonomously.

In this context:

  • the User is solely responsible for selecting and evaluating the suitability of a Skipper;
  • the User is encouraged to verify, where appropriate, the Skipper's qualifications, licences, and insurance coverage;
  • any agreement relating to boat services is concluded directly with the Skipper, under the User's own responsibility;
  • the User shall comply with all safety instructions and applicable regulations when using any service.

8. Intellectual Property

All content made available on the Platform is protected by applicable intellectual property laws and may be used only within the limits set out in these Terms.

In particular:

  • all texts, images, graphics, logos, icons, and software available on the Platform are the property of the Operator or are lawfully used by it;
  • such content may not be reproduced, distributed, modified, or otherwise used without prior written consent;
  • any unauthorised use may constitute a violation of applicable intellectual property laws.

With regard to content uploaded by Skippers, specific provisions apply.

In particular:

  • Skippers retain ownership of the content they upload (including photographs and descriptions);
  • by uploading such content, the Skipper grants the Operator a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it;
  • such use is limited to the operation, promotion, and improvement of the Platform.

This licence remains effective for as long as the content is available on the Platform.

9. Acceptable Use of the Platform

Users are required to use the Platform in compliance with applicable laws and in a manner that does not prejudice the rights of the Operator or other users.

In particular, Users shall refrain from the following activities:

  • using the Platform for unlawful or fraudulent purposes;
  • providing false, inaccurate, or misleading information;
  • attempting to circumvent or bypass the Unlock Fee or other payment mechanisms;
  • extracting, copying, or reusing data or content from the Platform without authorisation;
  • interfering with the functioning, integrity, or security of the Platform;
  • using the Platform to harass, spam, or otherwise harm other users.

Any conduct in breach of these provisions may result in appropriate measures by the Operator.

In particular:

  • access to the Platform may be suspended or terminated;
  • any unlawful activity may be reported to the competent authorities.

10. Liability of the Operator

The Operator performs its activities with due diligence and in accordance with applicable law, taking into account the nature of the service provided.

In particular, the Operator shall be liable only in the following cases:

  • where damage is directly attributable to its wilful misconduct;
  • where damage is caused by its gross negligence.

Given the nature of the Platform as a contact facilitation service, certain limitations apply.

In particular:

  • the Operator does not provide the services offered by Skippers;
  • the Operator does not participate in agreements concluded between Users and Skippers;
  • the Operator does not control the execution of such services.

Accordingly, the Operator shall not be liable for:

  • the performance, non-performance, or quality of services provided by Skippers;
  • the availability, conduct, or reliability of Skippers;
  • any damages arising from agreements or relationships between Users and Skippers.

In any case:

  • liability limitations shall not apply where prohibited by law;
  • consumer rights under the Italian Consumer Code remain unaffected.

11. Modifications of the Terms

The Operator may amend these Terms where necessary, in particular to reflect changes in the Platform or in applicable legislation.

In this respect:

  • updated Terms will be made available on the Platform;
  • Users will be informed of material changes through appropriate means;
  • changes shall take effect from the date of publication.

Continued use of the Platform after such date implies acceptance of the updated Terms.

12. Suspension and Termination

Access to the Platform may be subject to suspension or termination where necessary to ensure compliance with these Terms or the proper functioning of the service.

In particular, the Operator may intervene in the following cases:

  • violation of these Terms;
  • unlawful or improper use of the Platform;
  • conduct that may compromise security or functionality.

Such measures shall be proportionate and, where possible, preceded by a warning.

Upon termination access to the Platform may be discontinued and Skipper listings may be removed.

In any case rights already acquired by Users shall remain unaffected and access to unlocked contacts shall remain available for the applicable duration.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law.

In relation to disputes, where the User qualifies as a consumer, jurisdiction shall lie with the court of the place of residence or domicile of the consumer; in all other cases, jurisdiction shall lie with the Court of Como.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

In particular, the invalid provision shall be interpreted or limited to the extent necessary to ensure compliance with applicable law; the remaining provisions shall continue to apply in full.
